Marketing and 'Material' Information
What The Law Says:
The Digital Markets, Competition and Consumers Act 2024 (DMCCA) requires developers and housebuilders to ensure their websites (and those of their estate agents) display a regulated list of information that is 'material' to a buyer's ability to make an informed purchase decision. This is being enforced by the Competition & Markets Authority (CMS). Material Information was defined by National Trading Standards Estate Agent Team (NTSEAT). is currently maintaining the three part specification for MI, originally laid out by NTSELAT, which now required before a developer can market a property. Chimni’s MI ‘Marketing Pack’ solution delivers MI re-assurance and oversight to developers and estate agents alike.
The List of Required Information
Part A
Covers mandatory information (MI) for all properties:
- Council Tax band or domestic rates (NI).
- Property price or rent (single amount, not "offers in region of").
- Tenure type (Freehold, Leasehold, Shared Ownership, or Commonhold).
- For Leasehold: Ground rent, service charges, and length of lease.
- Other Service or Site charges (as applicable)
- For Lettings: Deposit amount.
Part C
Covers information that applies to most properties, which must be provided to avoid misleading consumers.
- Property type and structure: (e.g., detached, apartment, construction materials).
- Room sizes and types: (including floor plans).
- Utilities: Electricity, gas, water, and sewerage.
- Broadband and mobile signal: Coverage and availability
- Parking: Availability, cost, and restrictions (e.g., permits
Part C
Environmental & Specific Risks (only needs to be disclosed if a property is uniquely affected by or exposed to the following factors):
- Building Safety & Accessibility: Remediation work requirements, cladding usage, and accessibility adaptations.
- Environmental Hazards: Documented risk of flooding, coastal erosion, or nearby mining areas.
- Rights & Restrictions: Restrictive covenants, public rights of way, or specific easements.
- Planning & Development: Any known proposals for local development or recent planning permissions.
